Privacy Policy

This Privacy Policy describes our policies and procedures on the collection, use, disclosure, and protection of your personal information that you share with us (including when you use our Services) or which a third party shares with us. It tells you about your privacy rights and how the law protects you.

Adherence to the Privacy Act 2020:

We comply with the New Zealand Privacy Act 2020 (the Act) when dealing with personal information. Personal information is information about an "identifiable individual" (i.e. a natural person).

Interpretation and Definitions:

Interpretation

We use the words "includes" or "including" quite a lot in this Privacy Policy. When we use those words, we don't mean to limit the examples we list afterwards.

Definitions

For the purposes of this Privacy Policy:

  • Affiliate means in relation to a person (First Person), any other person which controls the First Person, is controlled by the First Person, or is under controlled by another person who also controls the First Person. In this context "control" means having the power (whether directly or indirectly) to exercise, or control the exercise of, more than 50% of the voting securities of that person or to otherwise control the business and affairs of that person.
  • Data Source refers to a third party source that may provide us with certain personal information (such as bank accounts or the IRD).
  • Device means any device that can access our Services such as a computer, a cellphone or a digital tablet.
  • Services refers to our websites, social media pages, apps, platforms, systems, products, solutions and services, including any events or functions we provide.
  • Third-Party Service refers to any third party website, platform, app or service through which a person can log in or create an account to use or access a Service.
  • Usage Data refers to data generated by or relating to the use of a Service, or from the infrastructure used to host or deliver a Service (for example, the duration of a page visit).
  • we, us or our refers to Usable Limited.
  • you or your refers to the individual in respect of which we've collected personal information, whether through accessing or using a Service or otherwise.

Collecting your personal information

Personal information you provide us

While using a Service, you may provide or we may ask you to provide us certain personal information. This information may include:

  • Identity data, such as your name, title, company/organisation name, email address, telephone numbers and physical address
  • Registration data, such as information provided by you when you register for an account or an event, including usernames and passwords
  • Recruitment data, including information submitted in connection with a job application or inquiry
  • Your feedback, including survey responses, recommendations, or other feedback from you about our Services

Usage Data

We collect Usage Data automatically when you use our Services.

Usage Data may include information such as your Device's IP address, browser type or version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

When you access a Service on mobile device, we may also collect the type of mobile device, your mobile device's unique ID, and your mobile operating system,.

We may also collect information that your browser sends whenever you access or use a Service.

Information from Data Sources

Some of our Services can be connected to Data Sources . The information we may collect from Data Sources includes your name, account numbers, balances, and bank transactions.

Information from Third-Party Services

For some of our Services you can create an account (and log in to use the Service) through Third-Party Services, such as your Apple, Google, or Microsoft accounts.

If you decide to register through or otherwise grant us access to a Third-Party Service, we may collect personal information that is already associated with your Third-Party Service's account, such as your name, your email address, and your profile picture.

You may also have the option of sharing additional information with us through your Third-Party Service's account.

Tracking technologies and cookies

We use cookies and similar tracking technologies to track the activity on some of our Services and store certain information. We use these to improve and analyse our Services. The technologies we use may include:

  • Cookies or Browser Cookies. A cookie is a small file placed on your device. You can tell your browser to refuse all cookies or to tell you when a cookie is being sent. However, if you do not accept cookies, you may not be able to use some parts of our Service, as cookies help a website remember the other places you've been on the website. Unless you have adjusted your browser setting so that it will refuse cookies, our Service may use cookies.

Certain sections of a Service and our emails may contain small electronic files known as "web beacons" (also referred to as clear gifs, pixel tags, and single-pixel gifs) that help us, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of a certain section and verifying system and server integrity).

Use of your personal information

We may use personal information for the following purposes:

  • To develop and improve the Services that we provide to you
  • To identify develop and deliver other functionality or Services that may be of interest to you

  • For conducting research, data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Services, marketing and your experience
  • For any other purpose associated with or ancillary to the above purposes
  • For any other purpose permitted under the Act

Aggregated Data

We may use your personal information (including Usage Data) in order to create (including by aggregating with other data) data sets that incorporate or are derived from your personal information (including Usage Data) (Aggregated Data). We may use, publish, distribute, license, sell and commercialise the Aggregated Data and/or reports based on or incorporating the Aggregated Data for any purpose, provided that before doing so we will ensure that the Aggregated Data is anonymised so that it does not contain any of your personal information.

Disclosure of your personal information

We do not sell, trade or rent your personal information to others.

We may share your personal information in the following situations:

  • With Service Providers: We may share your personal information with any person or business that supports, facilitates or is used to deliver our Services, including any person or business that hosts or maintains any underlying IT system or data centre that we use to provide our Services.
  • With Affiliates: We may share your personal information with our Affiliates, in which case we will require those Affiliates to adhere to this Privacy Policy.
  • With Your consent: We may disclose your personal information with your consent.
  • When required or authorised by law: We may disclose your personal information where we are permitted or required to do so by the Act or any other law (including for law enforcement purposes).
  • Business transactions: If we are involved in a merger, acquisition or asset sale, your personal information may be transferred to the purchaser.

We may share your personal information with recipients in other countries. However, we will not do this unless we are satisfied that they will be required to protect the information in a way that provides at least comparable safeguards to those under the Act or the disclosure is otherwise permitted under the Act.

Retention of your personal information

We will retain your personal information for as long as is necessary for the purposes set out in this Privacy Policy and to the extent necessary to comply with our legal obligations (for example, if we are required to retain your personal information to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer time periods.

Accessing and correcting your personal information

Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.

If you ask us to correct your personal information, if we think the correction is reasonable and we are reasonably able to change the personal information, we will correct it. If we do not correct it, we will take reasonable steps to include with the personal information a note that you requested it to be corrected.

If you want to exercise either of the above rights, please email us at legal@gousable.com. Your email should provide evidence of who you are and set out the details of your request (e.g. the personal information, or the correction, that you are requesting).

We may charge you our reasonable costs of providing to you copies of your personal information, including a note with any personal information you requested to be corrected, or providing you with assistance in relation to your request for access or a correction.

Security of your personal information

We take the privacy and protection of your personal information very seriously.

We will take reasonable precautions to protect your personal information from loss, unauthorised or accidental access, disclosure, alteration, destruction, other misuse and actions which prevent us from accessing your information on a temporary or permanent basis (a privacy breach).

If your personal information is subject to a privacy breach, we will comply with our obligations under the Act. These may include notifying you and/or a regulator if, for example, we believe the privacy breach may cause you serious harm.

Electronic communications

We are committed to complying with applicable anti-spam legislation, including the Unsolicited Electronic Messages Act 2007 in New Zealand.

By subscribing to receive emails and/or other forms of electronic communications (such as text or SMS), or otherwise providing your email address and/or mobile number, you consent to receiving emails and/or other forms of electronic communications (as the case may be) which promote and market our services, and the products and services of others.

You can unsubscribe from these communications at any time by following the "Unsubscribe" process in one of the promotional or marketing messages received.

Once you have unsubscribed, you will be removed from the corresponding marketing list within 5 working days (or such shorter period as may be required under the applicable anti-spam legislation).

Links to other websites

Our Services may contain links to other websites that we don't operate. If you click on a third party link, you will be directed to that third party's site. We strongly recommend that you to review the Privacy Policy of every site you visit.

We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.

Changes to this Privacy Policy

We may update our Privacy Policy from time to time. We will notify any changes by posting the new Privacy Policy on our website.

You should review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

We'll do our best to handle your complaint in a way that is fair and efficient. However, if you're not happy with how we've handled your complaint, in New Zealand you may complain to the Office of the Privacy Commissioner.
